By downloading, installing, or using WarmTies ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App. These Terms constitute a legally binding agreement between you and Serser Software Inc ("we," "us," or "our").

2. Description of Service
WarmTies is a personal relationship memory app that helps you record and recall important details about people you care about, including notes, voice memos, photos, important dates, and preferences. The App stores this information securely to help you maintain meaningful connections.
3. Eligibility
You must be at least 13 years of age to use WarmTies. By using the App, you represent and warrant that you meet this age requirement. If you are between 13 and 18, you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf.
4. User Accounts & Responsibilities
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to provide accurate, current, and complete information and to update it as needed. You must notify us immediately of any unauthorized use of your account.
5. User-Generated Content
You retain ownership of all content you create within the App, including notes, voice recordings, photos, and other information ("User Content"). By submitting User Content, you grant us a limited, non-exclusive license to store and process that content solely to operate and improve the App. We do not claim ownership of your User Content and will not share it with third parties except as described in our Privacy Policy.
You are solely responsible for ensuring you have the right to store information about other individuals. You agree not to store content that is illegal, defamatory, or that violates any third party's privacy rights.
6. Prohibited Uses
You agree not to:
- Use the App for any unlawful purpose
- Upload or transmit viruses or malicious code
- Attempt to gain unauthorized access to any portion of the App or its infrastructure
- Use the App to stalk, harass, or harm any individual
- Reverse engineer, decompile, or disassemble any part of the App
7. Intellectual Property
All rights, title, and interest in and to the App — including its design, features, logos, and source code — are owned exclusively by Serser Software Inc. Nothing in these Terms grants you any right to use our trademarks or branding without our prior written consent.
8. Disclaimer of Warranties
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE. YOUR USE OF THE APP IS AT YOUR SOLE RISK.
9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, SERSER SOFTWARE INC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF OR INABILITY TO USE THE APP, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
10. Termination
We may suspend or terminate your access to the App at any time, with or without cause, at our sole discretion. You may delete your account at any time through the App settings. Upon termination, your right to use the App ceases immediately.
11. Changes to Terms
We may update these Terms from time to time. We will notify you of material changes through the App or by email. Your continued use of the App after changes take effect constitutes your acceptance of the updated Terms.
12. Governing Law
These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of law principles. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of Ontario, Canada.
